Abstract

ZusammenfassungDie Einzelanalysen der OFAC-Settlements mit Nicht-US-Unternehmen verdeutlichen ein konsistentes Muster extraterritorialer US-Sanktionsdurchsetzung, bei dem funktionale Anknüpfungspunkte und nicht der Sitzstaat maßgeblich sind. In industriellen Fällen stehen fortgesetzte Liefer- oder Dienstleistungsgeschäfte sowie unzureichend integrierte Post-Merger-Strukturen im Vordergrund; im Bankensektor bildet der US-Dollar-Zahlungsverkehr über das US-Finanzsystem regelmäßig den entscheidenden US-Nexus. Typisch sind Verschleierungs- und Umgehungspraktiken, die trotz interner Hinweise oder externer Warnsignale über Jahre fortgeführt wurden. Für die Sanktionsbemessung sind insbesondere Systematik und Dauer der Verstöße, Management-Kenntnis, Qualität der Compliance-Strukturen sowie das Verhalten nach Aufdeckung (Selbstanzeige, Kooperation, Remediation) ausschlaggebend. Die Settlements entfalten dabei eine über den Einzelfall hinausgehende Wirkung: Sie verknüpfen die Fallbeilegung mit verbindlichen Compliance-Auflagen und etablieren faktische Mindeststandards für Sanktions- und Exportcompliance von Nicht-US-Unternehmen.
