Abstract

ZusammenfassungDie Untersuchung folgt einem qualitativen Fallstudienansatz und analysiert OFAC Settlement Agreements als öffentlich zugängliche Primärquellen zur US-Sanktionsdurchsetzung gegenüber Nicht-US-Unternehmen. Methodisch basiert sie auf einer qualitativen Inhaltsanalyse, die eine systematische, kategoriengeleitete Auswertung der veröffentlichten Enforcement-Dokumente ermöglicht und zugleich Raum für eine ergänzende quantitative Auswertung bietet (Mixed-Methods-Ansatz). Der Untersuchungszeitraum 2019–2024 erfasst eine Phase intensivierter US-Sanktionspraxis nach der Reaktivierung der Iran-Sanktionen. Analysiert werden 34 einschlägige Verfahren gegen Nicht-US-Unternehmen, überwiegend mit Settlement Agreements. Die Auswertung erfolgt entlang eines mehrstufigen Kategoriensystems (u. a. Unternehmensstruktur, Branche, US-Nexus, Sanktionsprogramm, Art des Verstoßes, Strafhöhe und Compliance-Maßnahmen) und zielt darauf ab, systematische Muster der extraterritorialen Durchsetzung sowie belastbare Schlussfolgerungen für die Ausgestaltung wirksamer Compliance-Programme abzuleiten.
