Abstract

ZusammenfassungOFAC reagiert auf Anhaltspunkte möglicher Sanktionsverstöße mit einem abgestuften Instrumentarium, das von der Einstellung ohne Maßnahmen über Verwarnungen und verwaltungsrechtliche Feststellungen bis hin zu zivilrechtlichen Geldbußen, Vergleichen und strafrechtlicher Zuleitung reicht. Maßgeblich für Art und Intensität der Reaktion ist eine einzelfallbezogene Faktorenabwägung, insbesondere hinsichtlich Sanktionszielrelevanz, wirtschaftlichem Umfang, Systematik des Verhaltens, Management-Kenntnis, US-Nexus, Kooperationsbereitschaft, freiwilliger Selbstanzeige sowie Qualität und Wirksamkeit der Compliance-Strukturen. Die Verfahrenseinleitung stützt sich auf vielfältige Informationsquellen – namentlich Selbstanzeigen, SARs/FinCEN-Daten und interbehördlichen Austausch. Settlement Agreements nehmen eine zentrale Rolle ein, da sie die Beilegung konkreter Verstöße mit verbindlichen Compliance-Verpflichtungen verknüpfen und dadurch faktisch branchenweite Mindeststandards der Sanktions- und Exportcompliance prägen.
