Abstract

ZusammenfassungDas Kapitel ordnet Compliance-Management als operatives Kerninstrument zur Beherrschung der Risiken aus US-Exportkontrolle und US-Sanktionen ein. Es zeigt, dass sich trotz unterschiedlicher Quellen – Wassenaar-Best-Practices, Nunn-Wolfowitz-Report, BIS Export Compliance Guidelines, OFAC Enforcement Guidelines und OFAC Compliance Framework sowie die Tri-Seal Compliance Note (2024) – ein konsistenter Mindeststandard herausbildet: Management Commitment, risikobasierte Analyse, wirksame interne Kontrollen, Screening und Genehmigungsprozesse, Dokumentation/Recordkeeping, Schulung sowie Testing/Audits und Korrekturmaßnahmen. Für Nicht-US-Unternehmen folgt daraus die Notwendigkeit eines integrierten ICP, das Exportkontrolle und Sanktionscompliance gemeinsam abdeckt und durch die US-Enforcement-Praxis faktisch zum globalen Erwartungsmaßstab geworden ist.
