Abstract

ZusammenfassungDie Auswertung der 32 OFAC-Settlements (2019–2024) zeigt eine konsequent extraterritoriale Durchsetzung des US-Sanktionsrechts gegenüber Nicht-US-Unternehmen. Zentraler Anknüpfungspunkt ist der US-Nexus, der in der großen Mehrheit der Fälle durch US-Dollar-Transaktionen über das US-Finanzsystem entsteht; im Finanzsektor ist dies praktisch der Regelfall und erklärt die dortige Dominanz bei Fallzahl und Strafvolumen. In Industrie- und Dienstleistungsbranchen treten daneben weitere Nexus-Konstellationen hinzu, insbesondere US-Ursprung/US-Technologie (Reexportregeln) sowie konzernrechtliche US-Bezüge. Bei den betroffenen Sanktionsregimen liegt ein klarer Schwerpunkt auf Programmen mit Bezug zum Nahen Osten, vor allem Iran, ergänzt durch weitere länder- und themenspezifische Regime. Qualitativ wiederholen sich Muster wie unzureichende Risikoanalysen, Defizite in operativen Kontrollen und Daten-/ITAffiliationids : Aff1, Correspondingaffiliationid : Aff1 Systemen sowie Verschleierung; strafmildernd wirken freiwillige Selbstanzeigen, Kooperation und wirksame Remediation. Konsequenz: Erforderlich sind risikobasierte, technisch integrierte und konzernweit verankerte Compliance-Programme, die Zahlungswege, Lieferketten und digitale Dienstleistungen systematisch abdecken.
