Abstract

Zusammenfassung Die arbeitgeberseitige Kündigung eines Arbeitsverhältnisses kann aus betriebsbedingten oder verhaltensbedingten Gründen gerechtfertigt sein, wobei das italienische Arbeitsrecht je nach Begründungs- oder Formmangel der Kündigung unterschiedliche Sanktionen vorsieht. Für Arbeitnehmer, die vor dem 06.03.3015 eingestellt wurden, gelten darüber hinaus besondere Vorschriften. Leitende Angestellte geniessen einen schwächeren Schutz vor Entlassungen, aber auch für sie gelten Kollektivverträge. Massenentlassungen folgen besonderen Regeln. Grundsätzlich hat der gekündigte, dann arbeitslose Arbeitnehmer Anspruch auf Arbeitslosengeld.
