Abstract

Zusammenfassung Patientenrechte, die sich im Laufe der Jahre größtenteils durch die Rechtsprechung als Richterrecht herausgebildet haben, werden nun durch das sogenannte Patientenrechtegesetz gesetzlich geregelt. Dies soll die Rechtslage eindeutiger und übersichtlicher gestalten und die Patientenrechte stärken. Der Beitrag fokussiert einerseits die Patientenrechte, den Behandlungsvertrag und die Pflichten der Patienten. Andererseits werden die Pflichten des Behandelnden aus dem Behandlungsvertrag erläutert.
