Abstract

Zusammenfassung Bei aller berechtigter Klage über Bürokratie ist zu fragen, welche Elemente einer bürokratischen Organisation auch an Hochschulen erforderlich sind. Es gibt gute Gründe, warum zum Beispiel „Regelhaftigkeit“, „Schriftlichkeit“ oder „Aktenförmigkeit“ in zentraler Hochschulverwaltung ebenso wie in der Selbstverwaltung nützlich und förderlich sind. Die juristische Arbeit der Verwaltung ist nicht verzichtbar; sie ist anspruchsvoll und muss im Team, orientiert an den Interessen der Hochschule, geleistet werden. Unzureichende Prozesse sowie mangelhafte Digitalisierung werden als Bürokratie oftmals einer rechtlichen Regelung selbst zugeschrieben, obwohl sie nur deren (mangelhafte) Implementierung sind. Subjektiv wahrgenommen als Bürokratie wird Verwaltungshandeln vor allem dann, wenn es den eigenen Interessen widerspricht. Interessen der Allgemeinheit und Schutzbedürfnisse mögen entgegenstehen. Bürokratieabbau fordert daher den Ausgleich widerstreitender Interessen und gelingt nur im Kompromiss.
