Abstract

Zusammenfassung Nachdem aufgrund des Status der meisten BIM-Pilotprojekte bislang der Fokus der Diskussionen um BIM und Recht auf der Planungsphase lag, kommen mit den fortschreitenden Umsetzungsgeraden von BIM nun auch zunehmend die Diskussionen auf, welche Veränderungen in rechtlicher Hinsicht, in der Vertragsgestaltung und im Vergabeverfahren durch die Umsetzung von BIM für die ausführenden Gewerke erforderlich sind. Dies betrifft insbesondere die Vertragsgrundlagen und damit die Kalkulationsgrundlagen, die Leistungsbeschreibung, die Vergütung und damit die Zuordnung etwa zu Besonderen Leistungen im Sinne der VOB/C sowie Haftung und Gewährleistung. Der Beitrag gibt einen Überblick zur rechtlichen Einordnung dieser Themen.
