Abstract

Zusammenfassung Veranstaltungshäuser sehen sich in jüngster Zeit einer wachsenden Anzahl politisch und medial polarisierender Veranstaltungsanfragen gegenüber. Dabei ist voranzustellen, dass insbesondere die Abwehrmöglichkeiten von Kommunen und ihrer kommunal beherrschten Tochtergesellschaften zur Beschränkung des Zugangs zu ihren Veranstaltungshäusern gegenüber „(extrem) polarisierenden Veranstaltungsinhalten“ deutlich begrenzter sind als vielfach angenommen. Sie sind regelmäßig Gegenstand gerichtlicher Entscheidungen. Im Falle einer unberechtigten betreiberseitigen Absage können insbesondere hohe Schadensersatzansprüche drohen. Dennoch sollte man den Prozess des Vertragsabschlusses sowie die Übertragung sicherheitskonzeptioneller Pflichten nach Maßgabe des § 38 und 43 MVStättVO proaktiv gestalten.
