Abstract

Zusammenfassung Zur weiteren Umsetzung des Europäischen Binnenmarkts wurden seit 2002 in der Europäischen Union mehrere Rechtsakte auf den Weg gebracht (z. B. die Mediationsrichtlinie sowie die Richtlinie über die alternative Beilegung verbraucherrechtlicher Streitigkeiten) und in nationales Recht umgesetzt, um in den Mitgliedstaaten eine effiziente und interessenwahrende Klärung von Konflikten außerhalb der Gerichte zu fördern. Diese Rahmensetzungen wurden in Deutschland von mehreren empirischen Studien zum Konfliktmanagement der Unternehmen begleitet, die aufzeigen, dass das ökonomische Potenzial des Konfliktmanagements nach wie vor (signifikant) unterschätzt wird und in der deutschen Wirtschaft zumeist ungenutzt bleibt. Die daraus abgeleiteten Impulse für das zukünftige Handeln der Unternehmen beziehen sich im Wesentlichen nur auf das operative Konfliktmanagement und dessen Einbindung in die etablierten Managementsysteme der Unternehmen.
