Abstract

Zusammenfassung Die Corona-Pandemie mit dem Lockdown von Betrieben und Homeoffice-Pflicht hat zu einer Entbetrieblichung geführt. Der traditionelle Zugang der Gewerkschaften zu Betrieben und Belegschaften ist dadurch erschwert, sodass digitalen Zugangsrechten zu außerhalb des Betriebs arbeitenden Belegschaften größere Bedeutung zukommt. Der Arbeitgeber ist nicht verpflichtet, Gewerkschaftsinformationen selbst aktiv an seine Beschäftigten zu verteilen bzw. weiterzuleiten mit eigenen Ressourcen (ArbG Bonn, Urt. v. 11.5.2022 – 2 Ca 93/22, NZA-RR 2022, 351) oder eine Seite der Gewerkschaft in seinem Intranet selbst aktiv mit eigenen Ressourcen zu pflegen bzw. zu betreiben (ArbG Hamburg, Urt. v. 31.3.2022 – 4 Ca 248/21, AuA 07/2022, 59). Dies gilt jedenfalls dann, wenn er der Gewerkschaft über sein Intranet die Möglichkeit gewährt, Informationen an alle Beschäftigten zur Verfügung zu stellen, die Gewerkschaft ihre Seite also selbst betreibt bzw. über gewerkschaftlich Organisierte betreiben lässt, worin die praktische Lösung besteht.
