Abstract

Zusammenfassung Staatsfundamentalnormen und Grundrechte bilden in ihrer Gesamtheit die Basis für die Wirtschaftsverfassung der Bundesrepublik Deutschland. Die Staatsfundamentalnormen „Rechtsstaat, Demokratie, Sozialstaat, Bundesstaat und Republik“ sind von so hoher Bedeutung, dass sie unveränderbar sind. Aus der Sicht der ökonomischen Verfassungstheorie ist dies plausibel, da bei Missachtung dieser Prinzipien hohe Diskriminierungskosten drohen. Die Grundrechte „Berufswahlfreiheit, Eigentumsschutz, Koalitionsfreiheit, Gleichbehandlung und allgemeine Handlungsfreiheit“ bilden die Leitplanken, innerhalb derer Marktwirtschaft in Deutschland gestaltbar ist. Die konstituierenden und regulierenden Prinzipien des Ordoliberalismus werden in der heutigen wirtschaftspolitischen Debatte für selbstverständlich genommen, zu Zeiten der Gründung der Bundesrepublik waren sie wichtige Gestaltungselemente der sich herausbildenden Sozialen Marktwirtschaft.
