Abstract

Zusammenfassung Mit der Einführung des nationalen Hinweisgeberschutzgesetzes (HinSchG) im Jahr 2023 sind die gesetzlichen Anforderungen an Unternehmen – also auch Kreditinstitute – zur Einführung von Hinweisgebersystemen deutlich gestiegen. Bisher gehörten Kreditinstitute zu den Unternehmen, für die es bereits Spezialregelungen in Bezug auf den Schutz von hinweisgebenden Personen gibt. Allerdings existierten zuvor ausschließlich für die zentrale Hinweisgeberstelle der BaFin konkrete Ausgestaltungsanforderungen. Die Konkretisierung der Anforderungen an ein Hinweisgebersystem durch das HinSchG erforderte Veränderungen bei bestehenden Hinweisgebersystemen in Kreditinstituten. Die Darlegung und der Vergleich bisheriger Ausgestaltungsanforderungen für Hinweisgebersysteme in Kreditinstituten sind Gegenstand dieses Beitrags.
