Abstract

Zusammenfassung Ohne Regeln funktioniert die neue Arbeitswelt nicht. Es ist ein Irrtum zu glauben, dass die New-Work-Welt mit weniger oder gar keinen Regeln auskommen wird. Schon allein die Thematik Home-Office oder Remote Arbeiten erfordern klare Vereinbarungen, denn einen generellen Anspruch auf das Arbeiten von zu Hause kann weder vom Arbeitgeber noch von den ArbeitnehmerInnen gefordert werden. Hat man sich allerdings geeinigt, dass Home-Office vom Unternehmen unterstützt wird, muss der Arbeitgeber darauf achten, dass er seine Pflichten uneingeschränkt einhält. Dasselbe gilt für die Arbeitnehmervertreter. Ihre Rechte und Pflichten enden nicht am Werkstor. Sie sind aufgefordert, Vereinbarungen mit dem Unternehmen zu treffen zu Arbeitszeiten, Arbeitsplatzgestaltung und -sicherheit im Home-Office sowie zu Kostenerstattungen für die Nutzung der Privat-Räume. Früher oder später werden diese Forderungen von den MitarbeiterInnen kommen, speziell im Hinblick auf die derzeitige Kostenexplosion. Keine diesbezüglichen Vereinbarungen enden oft vor dem Arbeitsgericht.
