Abstract

Zusammenfassung Der rechtliche Rahmen, in dem sich die Kommunalwirtschaft bewegt, unterliegt – wie Vieles und naturgemäß – Veränderungen bzw. Erweiterungen und stellt die Gemeinden vor besondere Herausforderungen. Denn dort, wo eine Gemeinde wirtschaftlich tätig wird, handelt sie im Bereich der grundgesetzlich definierten Daseinsvorsorge und hat somit, ihren Bürgern gegenüber, eine besondere Verantwortung. Während sich der Private unter dem Aspekt der (fehlenden) Gewinnerzielung aus bestimmten Wirtschaftsbereichen zurückziehen kann, ist für den Staat ein völlig freies Agieren unter betriebswirtschaftlichen Grundsätzen nicht möglich. Neben verschiedenen, sich hieraus ergebenden Herausforderungen im Wettbewerb, berührt die kommunalwirtschaftliche Tätigkeit verschiedene Rechtsmaterien ganz unterschiedlicher Herkunft und mit unterschiedlicher Zielsetzung.
