Abstract

Zusammenfassung Einzelfälle, Aktenanalysen und Fragebogenuntersuchungen belegen das Vorkommen falscher Geständnisse von Beschuldigten in polizeilichen Vernehmungen in Deutschland. Dies steht im Einklang mit internationalen Forschungsarbeiten. Falsche Geständnisse sind riskant, da Geständnisse im Allgemeinen Ermittlungen, Schuldeinschätzungen und die Interpretation anderer Beweismittel beeinflussen und in Justizirrtümern münden können. Dieses Kapitel behandelt das Vorkommen von falschen Geständnissen und beschreibt anhand einer zweidimensionalen Aufteilung nach Ausgangspunkt (Beschuldigte vs. Vernehmung) und Wiedergabeart (strategisch vs. internalisiert) vier Arten von falschen Geständnissen. Außerdem werden die Folgen falscher Geständnisse aufgezeigt und Handlungsempfehlungen zu deren Reduktion benannt.
