Abstract

Zusammenfassung Ohne Regeln funktioniert kein Wettbewerb. Nicht jedes Verhalten, was denkbar ist und Wettbewerbsvorteile verschaffen kann, ist akzeptabel. Vertragsfreiheit und die Einhaltung von Verträgen, das Eigentumsrecht und die Rechtsstaatlichkeit sind grundlegende Voraussetzungen für wettbewerbliche Ordnungen, aber auch für eine freiheitliche Gesellschaft. Andere Regeln wie der Verbraucherschutz oder Arbeitsschutzvorschriften sollen ungleiche Ausgangslagen angleichen, beispielsweise durch ein gutes Informationsangebot für die typischerweise schlechter informierten Verbraucher. Auch der Umweltschutz bildet einen wichtigen Rahmen, in dem sich der Wettbewerb entfalten kann. Damit wird ein Rahmen für Innovationen gesetzt, der aber auch nicht zu eng sein darf. Der Staat muss diese Regeln als neutraler Schiedsrichter überwachen und sollte daher möglichst nicht zugleich Regulierer und Regulierter sein.
