Abstract

Zusammenfassung Haftung bedeutet, dass eine Vertragspartei, die ihren Pflichten aus dem Vertrag nicht nachkommt, dafür einzustehen hat. Die Haftung wird per Gesetz vorgeschrieben für Leistungsstörungen, also für alle Arten und Formen von Vertragsverletzungen. Jede Abweichung der tatsächlichen Vorgänge in der Realität von dem, was gemäß Vertrag, AGB und Gesetz geschuldet ist, ist eine Leistungsstörung, die zur Haftung führen kann. Anknüpfungspunkt sind also immer die Pflichten der Parteien. Diese können in unterschiedlicher Weise verletzt werden.
