Abstract

Zusammenfassung Eine Möglichkeit, Ansprüche kollektiv im gewerblichen Rechtsschutz geltend zu machen, bietet die Gewinnabschöpfungsklage gemäß § 10 UWG. Mit der Gewinnabschöpfungsklage sollen Streuschäden durch unlautere Wettbewerbsmaßnahmen gerichtlich adressiert werden können. Die Gewinnabschöpfungsklage hat in der derzeitigen Fassung indes nur äußerst geringe praktische Relevanz, was in erster Linie daran liegt, dass der abgeschöpfte Gewinn nach § 10 Abs. 1 UWG dem Bundeshaushalt zugeführt wird und in keiner Weise dem Kläger zugutekommt.
