Abstract

Zusammenfassung Anders als in anderen EU-Mitgliedstaaten stand in Deutschland lange Zeit kein Rechtsbehelf zur kollektiven Durchsetzung von Einzelansprüchen zur Verfügung. Im Jahr 2005 wurde als Reaktion auf die Vielzahl von Anlegerklagen gegen die Deutsche Telekom zwar das sog. KapMuG erlassen, das seit dem 1.11.2005 in Kraft ist und bereits in diversen Verfahren angewendet worden ist. Mit diesem Verfahren besteht die Möglichkeit, im ersten Rechtszug die Feststellung des Vorliegens oder Nichtvorliegens anspruchsbegründender oder anspruchsausschließender Voraussetzungen oder die Klärung von Rechtsfragen (Feststellungsziele) begehren zu können (§ 2 Abs. 1 S. KapMuG).
