Abstract

Zusammenfassung Die erste Auflage dieses Werks führte in das Recht der Informationstechnologie ein (Fend & Hofmann, 2018, S. 211–228). Dabei wurde gezeigt, wie das seit über 100 Jahre alte deutsche Bürgerliche Recht (BGB, 2021) in der Lage ist, auch modernsten Entwicklungen des Digital-Business gerecht zu werden. Einen Überblick über die BGB-Vertragstypen gibt Abb. 15.1. Diese Vertragstypen kann man dann in der Regel wie in Abb. 15.2 dargestellt auf das Digital Business anwenden. Selbstverständlich sind auch Kombinationen dieser Vertragstypen möglich. In der zweiten Auflage dieses Werkes wurden die maßgeblichen Elemente der EU-Datenschutzgrundverordnung dargestellt (Fend & Hofmann, 2020, S: 225–241). Ein wesentlicher Bestandteil bildet in der Praxis die Vereinbarung zur Auftragsverarbeitung von personenbezogenen Daten nach Art. 28 EU-DSGVO (EU-DSGVO, 2018) zwischen dem Kunden (Verantwortlichen), der eine IT-Verarbeitung nicht selbst durchführt, mit einem Dritten als Auftragsverarbeiter. Dies wird im Folgenden behandelt.
