Abstract

Zusammenfassung Das Meldewesen für Finanzintermediäre, insbesondere für Banken, hat sich in Österreich parallel zum Bank(aufsichts-)recht entwickelt und ist zu einem bedeutenden Kosten- und Aufwandsfaktor für Finanzintermediäre geworden. Vor allem durch die gemeinschaftsrechtlich getriebene Angleichung der Bestimmungen in der EU und hier im Speziellen in der Euro-Zone stellt das Meldewesen ein eigenes weitverzweigtes Themengebiet dar, das stark im Aufsichtsrecht verankert ist, aber teilweise deutlich darüber hinaus geht, mit Querverbindungen zu den Datenanforderungen, die Notenbanken im Rahmen ihrer Geld- und Finanzmarktstabilitätspolitik formulieren. Als eine zu einem großen Teil mit Regulierung und Aufsicht verbundene Thematik wird das Meldewesen akzeptiert, hat aber mittlerweile für die beaufsichtigten Unternehmen, vor allem für die Banken, Grenzen des Machbaren erreicht beziehungsweise überschritten.
