Abstract

Zusammenfassung Datenschutz gehört nach Einführung der DSGVO für Unternehmen zweifellos zu den Themen, die in den letzten Jahren enorm an Bedeutung gewonnen haben. Dies hängt auch mit den hohen Geldbußen zusammen, die nunmehr regelmäßig von den Aufsichtsbehörden verhängt werden. Andererseits entdecken auch viele Kunden die Bedeutung ihrer sensiblen Daten, was beispielsweise zu vermehrten Auskunftsansprüchen bei den Firmen führt. Elementare Kenntnisse des Datenschutzes sind daher für jeden Unternehmer von größter Wichtigkeit. Dies gilt für organisatorische Vorgaben wie die Benennung eines Datenschutzbeauftragten, die Formulierung von Datenschutzerklärungen oder das Führen von Verfahrensverzeichnissen ebenso wie für den immer wichtigeren technischen Datenschutz. Auch auf Datenpannen sollte man vorbereitet sein und zumindest den Ablauf der darauf basierenden Meldepflichten kennen. Im nachfolgenden Kapitel fassen drei auf Datenschutzrecht spezialisierte Anwälte die wichtigsten Anforderungen praxisnah zusammen und erklären, welches Wissen in einem Unternehmen über die DSGVO zwingend vorhanden sein muss.
