Abstract

Zusammenfassung Auswahlentscheidungen können in mannigfaltiger Gestalt daherkommen. Ein wesentliches Merkmal im gesamten öffentlichen Dienst ist jedoch, dass diese sich, in den meisten Fällen, am Leistungsgrundsatz (Art. 33 Abs. 2 GG) zu orientieren haben. Dabei wiederum gibt es eine hinreichende Anzahl an Fallstricken, die es zu umgehen gilt. Schwerpunkt dieses Beitrages wird insoweit sein, dass wir uns mit dem Leistungsgrundsatz näher beschäftigten und insoweit Handlungsanreize bieten. Dabei kann man bei dem großen Feld der Personalauswahlverfahren durchaus differenzieren zwischen der ursprünglichen Begründung eines Dienstverhältnisses und der Frage, wie mit Auswahlverfahren umzugehen ist, wenn ein bereits begründetes Dienstverhältnis besteht. Fakt ist aber, dass diesbezüglich regelmäßig der Leistungsgrundsatz zur Anwendung gebracht werden muss. Dabei spielen dienstliche Beurteilungen eine wichtige Rolle.
