Abstract

Zusammenfassung Als Folge der Globalisierung und Internationalisierung wurde durch die in Kap. 1 beschriebenen internationalen Institutionen eine bedeutende Anzahl von Gesetzen und Strukturen zur Regelung des internationalen Handels geschaffen. Das Zusammenspiel von internationalen Regelungen soll in diesem Kapitel beispielhaft an den wichtigsten dieser Rechtsakte, überwiegend aus Sicht der EU, vorgestellt werden. Wichtiger Teilbereich der Logistik sind Transport und Lagerung. Rechtlicher Ausgangspunkt dieser Leistungen ist in der Regel ein Kaufvertrag. Entsprechend den 7 R der Logistik, des richtigen Produkts in der richtigen Menge, dem richtigen Zustand, am richtigen Ort, zur richtigen Zeit, beim richtigen Kunden und zum richtigen Preis ergeben sich rechtlich interessante Fragen, wie Leistungsort, Leistungszeit und beispielsweise die Vereinbarung von Allgemeinen Geschäftsbedingungen. Daher werden, ausgehend von Vorschriften des anwendbaren Rechts (Rom I, II) und neben AGB und INCOTERMS auch Fragen zum UN-Kaufrecht (CISG) oder der Force-majeur-Klausel angesprochen. Konkret geht es hier um die Lösung praktischer Fragen. Welches Recht ist auf internationale Sachverhalte anwendbar, welche Besonderheiten gibt es beim Eigentumsvorbehalt und welches Gericht ist bei internationalen Sachverhalten zuständig?
