Abstract

Zusammenfassung Die Nutzung sozialer Netzwerke ist für viele Kommunen ein Terrain auf dem neben den bisher in kommunalen Belangen relevanten Rechtsgebieten eine Reihe zusätzlicher Gesetze und Rechtsbereiche zu berücksichtigen sind. Neben dem aktuell auch öffentlich diskutierten Datenschutz, bei dem durch Information und Zustimmung der Nutzerschaft Rechtssicherheit hergestellt werden kann und der ebenfalls stark deklaratorischen Impressumspflicht in sozialen Medien, geht es um die Berücksichtigung der Rechte Dritter wie das Recht am eigenen Bild oder Urheberrechte. Generell stellt sich auch die Frage, wie eine Kommune in der Lage sein wird, den Anforderungen einer kontinuierlichen Information und Kommunikation zu entsprechen. Hier muss der Umfang des Äußerungsrechts der Kommune unter Wahrung der Verhältnismäßigkeit berücksichtigt werden.
