Crowdinvesting: Schwarmverbraucher?

Abstract

Zusammenfassung Obwohl bereits mehrere Crowdfunding-Projekte gescheitert und Verbraucherinnen und Verbrauchern dadurch finanzielle Verluste in Millionenhöhe entstanden sind, verzeichnet der Crowdfunding-Markt weiter steigende Investitionen. Hierbei rücken zunehmend Immobilienprojekte als vermeintlich wenig riskante Investments statt Beteiligungen an Start-ups in den Fokus. Inzwischen werden aber auch warnende Stimmen zu nicht durchschaubaren Risiken, gerade im besonders stark wachsenden Bereiche der Immobilien-Crowdinvestments, lauter. Aufgrund der aktuellen Regulierung fehlen für Verbraucherinnen und Verbraucher einerseits relevante Informationen zu den Risiken und Chancen der Crowdinvesting-Produkte, andererseits erzeugen sie bei den Verbraucherinnen und Verbrauchern trotz des Mangels an Information die Illusion, gut über das Produkt informiert zu sein. Der Beitrag formuliert Lösungsvorschläge für eine präventive Regulierung unter der Aufsicht der BaFin nach Wertpapierhandelsgesetz.
