Abstract

Zusammenfassung Direkte Kundenansprache wird für Unternehmen immer relevanter. Dabei ist es wichtig, ständig neue Interessenten zu generieren und diese möglichst zu Kunden heranreifen zu lassen. Gerade E-Mail-Kampagnen sind im Online-Bereich ein effizientes Mittel, um Leads zu generieren und über automatisierte Prozesse zu entwickeln. Doch aus rechtlicher Sicht können E-Mails auch schnell zu rechtswidrigem Spam werden. Die Grenzen sind oft fließend und somit muss jeder Einzelfall separat betrachtet werden. Um rechtlich unangenehme Folgen zu vermeiden, müssen insbesondere die Normen der neuen Datenschutz-Grundverordnung (DSGVO), des Gesetzes gegen den unlauteren Wettbewerb (UWG) sowie des Bürgerlichen Gesetzbuchs (BGB) beachtet werden. Anderenfalls können teure Abmahnungen oder Bußgeldverfahren der Datenschutzbehörden die Konsequenz sein.
