Abstract

Zusammenfassung Banken, die Bitcoin regulieren wollen, sind wie Dinosaurier, die Asteroiden regulieren möchten (Mike Gogulski). Weder der Prozess der Schaffung von Kryptowährungen, noch der Austausch ob gegen eine Fiat‐Währung oder gegen eine Ware und auch der reine Handel mit Kryptowährungen sind bis dato rechtlich einwandfrei definiert. Aufgrund der Neuartigkeit der Kryptotransaktionssysteme gibt es in den einzelnen Ländern die unterschiedlichsten rechtliche Zuordnungen von den jeweiligen Behörden bzw. gibt es auch Länder, deren Behörden bzw. Aufsichtsbehörden sich bis dato in keiner Weise zu einer rechtlichen Einstufung der Kryptowährungen geäußert haben. Inzwischen gibt es jedoch bereits verschiedene Ausarbeitungen und Diskussionen interessierter Juristen zu dem Thema. Bei der folgenden Diskussion der deutschen Rechtslage wird vor allem auf die Ausarbeitung von Moritz Schröder, Bitcoin: Virtuelle Währung – reelle Problemstellungen, JurPC Web‐Dok. 104/2014 Bezug genommen.
