Umgang mit IP-bezogenen Spannungen zwischen Universitäten und Ausgründungen

Abstract

Zusammenfassung Geistiges Eigentum (Intellectual Property, IP) ist ein entscheidender Vermögenswert für das Wachstum von universitären Ausgründungen. Da das IP in der Regel der Mutteruniversität gehört, müssen Ausgründungen eine Vereinbarung über den Zugang dazu treffen. Es gibt jedoch nur wenige Erkenntnisse darüber, wie die Technologietransferstellen (TTOs) der Universitäten und die Ausgründungen zu einer solchen Vereinbarung gelangen. Diese Studie zielt darauf ab, diesen Prozess zu beleuchten. Basierend auf vier Schweizer und deutschen TTOs sowie 12 zugehörigen Ausgründungen geben die Autoren Einblicke in die Navigation durch diesen Prozess. Die Daten zeigen, dass beide Parteien während der Verhandlungen mit vier zentralen Spannungsfeldern konfrontiert sind: (1) Der Erfolg der TTO könnte den Erfolg der Ausgründung behindern; (2) Die TTO besitzt das IP, ist aber kein Berater für IP-Schutz; (3) Bedarf an standardisierten, aber dennoch maßgeschneiderten Prozessen; (4) Unabhängigkeit der Ausgründung, aber weiterhin Abhängigkeit von der Universität. Die Autoren leiten zudem Implikationen aus dieser Studie ab, die helfen, diese Spannungen zu überwinden.
