Enforceability of Sustainable Finance Commitments

Abstract

The credibility of a sustainable finance feature depends on the extent to which the company will be bound by the commitments comprising that structure. This chapter assesses the factors tending to ensure companies remain bound by those commitments, ranging from intentionally limited contractual remedies to the market and reputational considerations most relevant in practice. Although enforceability in this context is different from other financial or regulatory requirements, experience in the market has been near uniform adherence by sustainable finance companies.
