Abstract

Employees are truly the backbone of any organisation since they give the skills and expertise needed to keep productivity levels high. Employee relations is concerned with developing and delivering people practices that foster positive working connections between an organisation and its employees. Trade unions bargain with employers on behalf of their members and negotiate collective bargaining with employers through their leadership. Workers join trade unions in the hopes of obtaining greater compensation through collective bargaining. Better working conditions, such as increased statutory leave entitlement or improved health and safety, can be negotiated. Employees who are members of trade unions have specific rights as a result of their membership and, recently, through legislation, coupled with new constitutional dispensations. Employee-employer relations, which entail the management of contracts of employment, as well as their regulatory frameworks and institutions, are undergoing significant transformation in today’s capitalist countries. This has corresponded with structural developments that have resulted in congruence in outcomes rather than convergence in patterns within (and across) African countries, particularly Kenya. This chapter is an inquiry into employee relations and trade unions in Kenya.
