The Role of Lawyers in Countering Disinformation Attacks

Abstract

This chapter explains the specific role of lawyers in disinformation attacks—in the “war room,” in acute defense, and in the subsequent clean-up phase. It highlights the tensions between legal diligence and the speed required in crises and calls for a new balance model based on risk acceptance, rapid coordination, and clear responsibilities. It is argued that effective legal measures only take effect after attribution through forensics/OSINT; prior to that, communication and technology take precedence. International case studies illustrate rapid instruments such as interim injunctions and takedowns but also legal hurdles (e.g., high defamation thresholds in the UK and the First Amendment framework in the USA). A particular focus is placed on deepfakes as an escalation factor and on how lawyers, through preparation and governance, can shift from being a brake to becoming enablers.
