Abstract

This chapter introduces the various types of corporate bankruptcies and why companies may select one over the other. We explore Chap. 11 reorganization further in-depth and include an overview of the process. This chapter will also go into detail related to a 363 sale process with a stalking horse bidder and the benefits and pitfalls related to such a transaction. We explore the role of the bankruptcy court and first day motions, as well as the formation of the Uninsured Creditors’ Committee. We explore the effect of Chap. 11 bankruptcy on foreign employees.
