Abstract

Current events on each side of the Atlantic center on movements to revise patent protection. In 2011, President Obama signed the American Invents Act that will reshape the US patent law and the European Commission proposed a single European patent for 25 Member States (excluding Spain and Italy). In 2010, the Prioritizing Resources and Organization Property Act of 2008 (PRO IP Act) created a position within the Executive Office of the US President, the Intellectual Property Enforcement Coordinator (IPEC). The protection of intellectual property rights (IPR) through trade initiatives such as the STOP! Program in the United States and the EU Enforcement Directive are examined in this chapter. This chapter is designed to provide a synopsis of the latest government policymakers’ tactics designed to battle counterfeiters. The question of whether the STOP! Program in the United States, the novel directive in the EU on enforcement, and recent patent protection legislation will reduce fakes is a matter for future assessment. However, previous studies have already established that enforcement of any type of government and/or multilateral agency-sponsored anti-counterfeiting strategy remains a leading concern in the continuing battle to reduce the proliferation of fake goods (Chaudhry et al. 2010).
