Barriers and Legal Restrictions for Local Government Units Managing the Development of Tourism in Poland

Abstract

Tourism should not be regarded as a stand-alone sector because it is affected by many other sector policies. It needs coordinated activities of numerous partners, who are directly or indirectly interested in developing this sector of the economy. Local government units are to play a key role in this sphere. Major barriers and legal restrictions that local government units face while managing tourism development were presented; potential conflict areas were explored in various legal acts and suggestions for overcoming such obstacles were submitted. The basis of analysis were empirical observations and analyses administered by local government staff from departments responsible for tourism and also external commentators were interviewed, including academic researchers and representatives of regional tourism organisations involved in regional tourism policies. Hence, legal acts and other regulations were subjected to analyses whenever they concerned tourism services, Polish Tourism Organisation, a private-public partnership, public interest activities, businesses of public individuals, railway transport, public orders, local taxes, activities of associations and the Petty Offence Code. Furthermore, suggestions were made for drafting new bills, i.e. “the law of tourist trails”, as well as “the snow law”/ “mountain law”.
