Abstract

South Korea is a democratic republic whose administration is the responsibility of a President who functions not only as Head of the Executive Branch, but also as Head of State in foreign relations, hence President Chun’s official tour of the world in 1982. Likewise he is Head of State Council as well as Commander in Chief of the Armed Forces. His reponsibilities also include the power to appoint or relieve the Prime Minister, the Cabinet, heads of government agencies and offices, ambassadors, provincial governors and other senior public officials. He can conclude treaties, receive or dispatch diplomatic envoys, declare war or conclude peace. In a state of emergency, such as a civil war, natural calamity, grave economic or financial crisis, or imminent threat of a foreign invasion, he would be able to issue ordinances having the effect of law. Within limits, he can grant amnesty, commutation and rehabilitation. He is not, however, a dictator: the Republic of South Korea is constitutionally committed to be democratic and peaceful in pursuit of domestic and international policies, denouncing aggressive war and abiding by all international laws.
