Abstract

The current cause for agitation and concern among employers and their insurers is the possibility of workplace personal injury claims being initiated. This can happen when the employee suffers a breakdown in health, caused by continual stress at work, over a long period of time (Buckingham, 1992; Lapper, 1994). In the USA ‘cumulative stress trauma’ cases are common and in the 1980s these cases tripled (Karasek and Theorell, 1990). Although the Worker’s Compensation Scheme in the USA differs from the compensation system in the UK, there are indications that litigation based on cumulative trauma or chronic stress will become a significant issue in UK law.
