Abstract

The controversies regarding the inclusion of intellectual property in the World Trade Organization (WTO) talks are well documented in the literature, in particular, on the agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). A number of experts have studied the impact of implementing the TRIPS agreement in India (see for example Galpalli 2004; Lanjouw 1998; Scherer and Watal 2001). However, the impact of TRIPS in India is most comprehensively covered by Chaudhuri (2005). While the global media has drawn attention of governments, public health activists, and non government organisations (NGOs), a significant number of articles covering specific aspects of the impact have also been published in academic journals. Notwithstanding the great contributions made by the distinguished authors and experts in the field, none of the studies examines the issues in the post-TRIPS setting, as all the studies were undertaken pre-implementation and/or relied on pre-TRIPS data.
