Abstract

Directive 2001/24/EC (the Winding-up Directive) aims to avoid unequal treatment of creditors and conflicts of jurisdiction that may arise from the initiation of separate insolvency proceedings affecting a credit or financial institution established in different EU Member States. The Winding-up Directive lays down information and publication requirements designed to protect creditors and customers and provides for cooperation between supervisory authorities at a European level.
