Does personal data protection matter in data protection law? A transformational model to fit in the digital era

Abstract

The accelerating use of online platforms due to technological advancements as digital thefts escalated. Of these a significant amount is related to misappropriate use of personal information shared by individuals in the digital platforms. Subsequently, to address these issues data protection law has undergone enamours changes but amplifying invasion into the privacy of individuals has questioned the effectiveness of these regimes. Personal data protection is complex and requires scrutiny and adaptation to the changing environment. So, this paper recommends adoption of the Complex Adaptive System model to address the two key issues: 1. How personal data is classified in various categories so entities, regulatory bodies and researchers could determine the potential risks. 2. Could a self-controlled and co-evolved model possibly reduce failure due to dynamic circumstances in future. Further, concluding that it is not of greater help to look at the advanced privacy regimes like European GDPR to fill these inadequacies, thus a complex, systematic, and dynamic model could protect personal data from risks.
