Abstract

Article 11 pertains to the law applicable to the service of documents. The Regulation itself does not set up any rules for the service as such. Instead, the Regulation refers to the applicable domestic law of a Member State. Hence, there are no uniform rules on the service of documents in the EU. However, as Article 45(1)(b) Brussels Ibis Regulation sets up grounds for refusal of recognition of a decision by a Member State’s court if the defendant was not served with the document instituting the proceedings in sufficient time and in such a way as to enable him to arrange for his defence, there are certain minimum standards as to the process of service.
