Abstract

Chapter 18 (Central and Eastern European Countries by Jurgita Malinauskaite) discusses private enforcement of competition law in the Central and Eastern European (CEE) countries. While reflecting on recent developments, the chapter explores the extent to which private enforcement of competition law is workable in practice in these MS (with some illustrative examples presented from Lithuania) and what are the main barriers in invoking a claim for damages resulting from an infringement of the antitrust provisions. Despite the transposition of the Antitrust Damages Directive and new changes introduced in the CEE domestic legal systems to boost private antitrust enforcement, so far there have not been any noticeable improvements, as there have barely been any post-transposition cases reported.
