Abstract

This chapter deals with the recognition and enforcement of judgments rendered by the courts of a EU Member State in other Member States. In particular, it addressed the basic underpinning ideas of recognition and enforcement, object, extent and effects of recognition, partial recognition and procedural matters relating to the recognition and enforcement. It addresses the abolishing of exequatur introduced by the Recast and analyses extensively the grounds for refusal of recognition and enforcement under the Regulation, as well as the role of grounds under national laws of the Member States.
