The Regulation of Global Corruption

Abstract

This chapter explains the international system for regulating corruption in cross-border business transactions, including trade and foreign investment. It begins by describing the scope and nature of the problem of corruption in international business, and the utility of unofficial indices such as Transparency International’s Corruption Perceptions Index. It summarizes the treaty-based responses to global corruption on the multilateral and regional levels. The chapter then introduces the U.S. Foreign Corrupt Practices Act, including discussing its jurisdiction, interpretation, exceptions and defenses, and penalties. It also briefly outlines the options for informal regulatory guidance regarding contemplated future transactions that might potentially be viewed as violations of the Act. It concludes with a practice essay and multiple choice questions.
