Patent fees

Abstract

Patent fees is an essential part of patent systems, a necessary condition that must be fulfilled to file, validate and maintain a patent in force. Yet, this dimension is barely tackled in economic analyses of patent systems, despite the significant heterogeneity observed across countries. This chapter aims at summarizing the current state of knowledge and information on the role of fees in patent systems. Four main sections are included: i) stylized facts on the fee structure in several patent systems; ii) scientific evidence on the impact of fees on patent applicants' behavior; iii) simulations of the drastic changes that would be induced by the setting up of a unitary patent for the European Union; iv) some policy recommendation on the future of patent systems.
