The EU regulations on matrimonial property regimes and on the property consequences of registered partnerships

Abstract

When persons marry or register as partners, they become entitled to each other’s property, but in what way and to what extent depends on what law applies to their property relations. All EU Member States had their own conflict of law rules on matrimonial property and only a few EU Member States had conflict of law rules on property relations of registered partnerships. Only three EU Member States ratified the Hague Convention of 14 March 1978 on the law applicable to matrimonial property regimes. This changed when the Regulations on Matrimonial Property Regimes and on the Property Consequences of Registered Partnerships entered into force. An overview of their content and impact is given.
