Legal competences in pension matters

Abstract

The term "European pension law" might wrongly suggest that there is a legal corpus of acts concerning pensions at a European scale. This is clearly not the case. European pension law is only a generic term for all legal acts the European Union (as a whole) has taken with regard to pensions. Just as pension models do not exist in legal terms, comprehensive taxonomies encompassing the different pension systems don't exist either. The relevance of categorizing pension systems is from a legal point of view highly questionable. The great diversity of pension systems makes it just too difficult to classify coherently. The concept of the word 'pension' refers to different and various underlying values in different Member States. The word or concept of pension is indeed and without any doubt multidimensional. The current modern legal realities of pension law are clearly based on several ideas of pensions or designs of pension systems.
