Abstract

El capítulo analiza la regulación del encaje legal para los bancos en Colombia, específicamente para el Banco de la República. Se discuten las modificaciones introducidas por la Ley 17 de 1925 y sus implicaciones. Los puntos clave son: 1. El encaje legal para los bancos accionistas del Banco de la República se redujo del 25% al 15% para depósitos a la vista y del 12,5% al 5% para depósitos a plazo. 2. La Ley 17 permitió que hasta el 25% del encaje se mantuviera en monedas de plata colombianas y hasta el 2% en monedas de níquel. 3. Se cuestiona la conveniencia de estas modificaciones, ya que reducen la liquidez de los bancos y pueden generar problemas en situaciones de emergencia. 4. Se analiza la posibilidad de reducir el encaje legal del Banco de la República del 60% al 50% y permitir que se mantenga en moneda legal en lugar de oro. 5. Se discute la conveniencia de permitir que el Banco de la República mantenga parte de sus reservas en oro en el exterior, lo que podría generar un sistema de tipo de cambio oro.
